- Business transfers, to a buyer or successor in a merger, acquisition or sale of assets, subject to this Policy.
Our service providers may use personal information only to provide services to us, must protect it, and may not use it for their own purposes except as permitted by their own terms and applicable law.
6. Cookies and similar technologies
We use cookies, pixels and similar technologies in the following categories:
- Strictly necessary, required for the cart, checkout, security and remembering your cookie choice. These are always on.
- Analytics, to understand how the Website is used.
- Marketing and advertising, to measure ads and show relevant ads on other websites and social media.
Analytics and marketing cookies are used only if you click "Accept" on our cookie banner. If you click "Decline", only strictly necessary cookies are used. You can change your choice at any time through the cookie settings link on the Website or by clearing cookies in your browser. Blocking all cookies may prevent parts of the Website, such as checkout, from working.
7. Where your information is stored
We are based in Canada, but our service providers may store and process personal information in other provinces and in other countries, including the United States. Information processed outside your province or country is subject to the laws of that place and may be accessible to its courts, law enforcement and national security authorities. We use contracts and other measures to require that it receives a level of protection comparable to that required in Canada.
8. Retention
We keep personal information only as long as needed for the purposes for which it was collected or as required by law. In general:
- order, payment and tax records: as long as required by tax and accounting law (generally up to 7 years);
- warranty registrations and claims: for the warranty period plus a reasonable period afterwards to handle disputes;
- customer support messages: up to 3 years after the matter is resolved;
- marketing consent records: while you are subscribed and for the period required to demonstrate consent;
- cookie data: for the period shown in our cookie settings.
When no longer needed, information is securely destroyed or anonymized.
9. Security
We use reasonable administrative, technical and physical safeguards appropriate to the sensitivity of the information, including encrypted (HTTPS) connections, a PCI-compliant checkout, access limited to those who need it, and contractual protections with service providers. No method of transmission or storage is completely secure. If a privacy incident creates a real risk of significant harm, we will notify affected individuals and regulators as required by law.
10. Your rights and choices
Subject to the law that applies to you, you may:
- ask whether we hold personal information about you and obtain access to it;
- ask us to correct inaccurate or incomplete information;
- withdraw your consent, or ask us to delete your information where we no longer need it;
- unsubscribe from marketing at any time;
- change your cookie choices at any time.
To make a request, email support@eivoge.com with the subject "Privacy Request". We may need to verify your identity before acting. We will respond within 30 days of receiving your request, unless the law allows an extension, in which case we will tell you. Requests are free of charge, except where the law allows a reasonable fee for excessive requests, which we will tell you about in advance.
11. Marketing communications
We send commercial emails or text messages only with your express consent, or where otherwise permitted by law. Every marketing message identifies EIVOGE and includes our contact information and a simple way to unsubscribe, such as a link in emails or replying STOP to texts. We process unsubscribe requests promptly, and within 10 business days. You will still receive transactional messages about your orders, warranty claims and service.
12. Automated decisions
We do not make decisions about you based solely on automated processing that produce legal or similarly significant effects. Our platform and payment processors use automated fraud-screening tools; if an order is held or cancelled as a result, you may contact us to have it reviewed by a person.
13. Children
The Website is not directed to children, and we do not knowingly collect personal information from children under 13 (or under 14 in Quebec) without the consent of a parent or guardian. If you believe a child has provided us information, contact us and we will delete it.
14. Third-party websites
The Website may link to third-party websites, including authorized retailers and social media. Their privacy practices are governed by their own policies, not this one.
15. Changes to this Policy
We may update this Policy from time to time. The "Last updated" date shows when it was last changed. We will post material changes on the Website and, where required by law, notify you by other appropriate means before they take effect.
16. Questions and complaints
Please contact us first at support@eivoge.com so we can try to resolve your concern. You may also contact the privacy regulator listed in the Canada or United States section below.
CANADA
C1. Applicable law
We handle personal information in accordance with the Personal Information Protection and Electronic Documents Act (PIPEDA) and, for residents of Quebec, the Act respecting the protection of personal information in the private sector (as amended by Law 25). Commercial electronic messages are sent in accordance with Canada's Anti-Spam Legislation (CASL).
C2. Accountability and openness
Our President and CEO is accountable for our compliance with this Policy. On request, we will provide information about our privacy practices and policies.
C3. Quebec residents
If you live in Quebec, in addition to the rights above:
- Privacy by default. Tracking, analytics and advertising technologies that can identify, locate or profile you are off by default and are activated only if you choose to accept them.
- Information about collection. You may ask for the purposes of collection, the categories of persons who have access to your information, how long it is kept, and the contact details of our privacy officer.
- Portability. You may ask to receive personal information you provided to us in a structured, commonly used technological format, or to have it sent to an organization you designate.
- De-indexation. You may ask us to stop disseminating your personal information or to de- index any hyperlink attached to your name, where the dissemination is unlawful or causes you serious injury, as provided by law.
- Automated decisions. If a decision about you is ever based exclusively on automated processing, we will inform you, and you may ask for the information used, the reasons and principal factors, and to submit observations to a person who can review the decision.
- Transfers outside Quebec. Before communicating personal information outside Quebec, we assess whether it will receive adequate protection, and transfers are covered by written agreements.
- Confidentiality incidents. We keep a register of confidentiality incidents and notify the Commission d'accès à l'information and affected individuals when an incident presents a risk of serious injury.
The French version of this Policy for Quebec is available on the Website. Quebec residents may file a complaint with the Commission d'accès à l'information du Québec (www.cai.gouv.qc.ca).
C4. Complaints in Canada
If you are not satisfied with our response, you may contact the Office of the Privacy Commissioner of Canada (www.priv.gc.ca) or, in Quebec, the Commission d'accès à l'information du Québec.
UNITED STATES
U1. Scope
U.S. customers currently buy EIVOGE products through authorized third-party retailers. Information you give a retailer when you buy there is governed by that retailer's privacy policy. This section applies to information we collect from U.S. residents through the Website, product registration, warranty claims, customer support and our communications.
U2. Categories of personal information
In the past 12 months, we may have collected the following categories, as described in Section 2: identifiers (name, email, phone, address, IP address, cookie identifiers); customer records (contact and purchase details); commercial information (products registered, purchase and warranty history); internet or other electronic network activity (browsing and interaction with the Website and ads); approximate geolocation derived from IP address; audio or visual information (photos you send for a claim or review); and inferences about product preferences. We collect these from the sources and use them for the business purposes described in Sections 2 and 3, and disclose them to the categories of recipients in Section 5. We keep them for the periods described in Section 8.
U3. Sale, sharing and targeted advertising
We do not sell personal information for money. However, if you accept marketing cookies, advertising partners may collect identifiers and online activity through our Website for cross-context behavioural (targeted) advertising, which some state laws treat as a "sale" or "sharing". We do not knowingly sell or share the personal information of consumers under 16.
You can opt out by:
- clicking "Decline" on our cookie banner or changing your cookie settings;
- using the "Do Not Sell or Share My Personal Information" (Your Privacy Choices) link on the Website; or
- enabling the Global Privacy Control (GPC) signal in a supported browser. We treat GPC as a valid opt-out request for that browser.
U4. Sensitive personal information
We do not collect or use sensitive personal information for purposes that would require a right to limit its use under California law.
U5. Your state privacy rights
Depending on your state of residence (including California, Colorado, Connecticut, Virginia, Texas, Oregon and other states with consumer privacy laws), you may have the right to:
- know what personal information we collect, use and disclose, and access a copy of it, including in a portable format;
- correct inaccurate personal information;
- delete personal information, subject to legal exceptions;
- opt out of sale, sharing, targeted advertising and profiling that produces legal or similarly significant effects;
- not be discriminated against for exercising your rights. We will not deny goods or services, charge a different price, or provide a different level of quality because you exercised a privacy right.
To make a request, email support@eivoge.com with the subject "Privacy Request" and your state of residence. We will verify your request by matching information you provide with information we hold, and respond within the time required by law (we aim for 30 days; in some cases up to 45 days, which may be extended once where permitted, with notice to you).
U6. Authorized agents
You may use an authorized agent to make a request on your behalf. We may require written, signed permission from you and may ask you to verify your identity directly, unless the agent holds a valid power of attorney.
U7. Appeals
If we decline your request, you may appeal by replying to our decision or emailing support@eivoge.com with the subject "Privacy Appeal". We will respond in writing within the time required by your state's law, generally 45 or 60 days. If you are not satisfied, you may contact your state Attorney General.
U8. Children
In accordance with the Children's Online Privacy Protection Act (COPPA), we do not knowingly collect personal information from children under 13. If we learn that we have, we will delete it.
U9. Do Not Track
Some browsers send "Do Not Track" signals. Because there is no common standard for responding to them, we do not respond to Do Not Track signals; however, we honour the Global Privacy Control signal as described in Section U3.
U10. California "Shine the Light"
California residents may ask whether we have disclosed personal information to third parties for their own direct marketing purposes. We do not make such disclosures.
