EIVOGE, operated by Infinite Atlas Trading Group Inc.
These Terms of Service ("Terms") apply to www.eivoge.ca and www.eivoge.com (together, the "Website"). The Website is operated by Infinite Atlas Trading Group Inc., a Canadian corporation doing business under the EIVOGE brand. In these Terms, "EIVOGE," "we," "us," and "our" refer to Infinite Atlas Trading Group Inc.
These Terms have three parts: General Terms that apply to everyone, Additional Terms for Customers in Canada, and Additional Terms for Customers in the United States. If a regional section conflicts with the General Terms, the regional section applies.
Nothing in these Terms excludes, limits or waives any right or remedy you have under consumer protection or other laws that cannot lawfully be excluded, limited or waived.
GENERAL TERMS
1. Acceptance of these Terms
By using the Website or placing an order, you agree to these Terms, subject to your rights under law. Our Privacy Policy, Shipping Policy, Return and Refund Policy and Limited Warranty contain additional information and should be read together with these Terms.
2. Accounts
If you create an account, you are responsible for keeping your login details confidential and for activity under your account. Contact us right away if you believe your account has been used without permission.
3. Products and product safety
EIVOGE offers electrical hair-care and styling products, including the Smart AI Hair Dryer and StyleAir 6-in-1. Use products only for their intended household purposes, and do not modify them or attempt unauthorized repairs.
Please read and follow the user manual and safety instructions before use. Information about product safety notices or recalls will be posted on our website.
4. Product information, availability and errors
We aim to present accurate images, descriptions, specifications, availability and prices. Colours and appearance may vary slightly depending on your screen. We may update or correct Website information at any time. If we discover a material error in the price or description of a product you have ordered from us, we will contact you before shipping and let you choose to continue at the correct price or cancel for a full refund.
4A. Personal use and quantity limits
Our products are sold for personal and household use, not for resale. EIVOGE may set a maximum quantity per order or per customer according to its policy in effect. Any applicable limit is displayed before you place your order.
5. Shipping and returns
Shipping and returns for orders placed directly with EIVOGE on our websites are governed by our Shipping Policy and Return and Refund Policy for your country. Purchases made through third-party retailers are governed by that retailer's shipping and return policies, and EIVOGE's limited warranty still applies.
6. Limited warranty
EIVOGE products are covered by a one-year limited warranty against defects in materials and workmanship under normal household use, starting on the original purchase date. The full warranty terms are available at eivoge.ca/pages/warranty and eivoge.com/pages/warranty. For U.S. customers: this warranty gives you specific legal rights, and you may also have other rights which vary from state to state.
To make a warranty claim, email support@eivoge.com with your proof of purchase (an order confirmation, receipt or invoice from EIVOGE or an authorized retailer) and a description of the issue. Please contact us for instructions before sending any product.
7. Intellectual property
The EIVOGE trademarks, images, website content, graphics, photographs, product materials and designs are owned by Infinite Atlas Trading Group Inc. or used under licence or authorization. You may not reproduce, distribute, modify or commercially use this material without our permission, except as permitted by law.
8. Acceptable use
You must not interfere with Website security, access accounts or systems without authorization, distribute malicious code, misuse Website services, or use the Website for unlawful purposes. We may take reasonable security or account-protection measures, subject to applicable law.
9. Suspension of access
We may suspend or restrict access to the Website or an account if it is being used in breach of Section 8 or unlawfully. This does not affect orders you have already paid for or your rights under law.
10. Website availability
We work to keep the Website available and accurate, but we cannot guarantee that it will always be uninterrupted or error-free. We may change, pause or discontinue parts of the Website, for example for maintenance. This section does not limit any obligation we owe you for products you purchase.
11. Third-party websites and retailers
The Website may link to third-party websites, including authorized third-party retailers and social media. Those websites have their own terms and privacy policies, which we do not control. These links do not reduce our responsibilities for our own products, statements and warranty.
12. Reviews and feedback
If you send us reviews, comments or suggestions, you confirm that they are your own, honest and lawful, and you allow us to use them to improve and promote our products. We will not publish your full name with a review without your permission. We may decline to publish content that is unlawful, offensive or unrelated to our products, but we will not remove reviews only because they are negative.
13. Privacy
Personal information is handled in accordance with our posted Privacy Policy and applicable privacy law.
14. Marketing messages
We send marketing emails or text messages only if you have given us your consent, for example by checking the sign-up box at checkout or subscribing to our newsletter. Every message identifies EIVOGE and includes an easy way to unsubscribe at any time. Order confirmations, shipping notices and other transactional messages are sent as needed to complete your order.
15. Limitation of liability
To the extent permitted by applicable law, EIVOGE is not responsible for losses caused solely by misuse of a product or unauthorized modifications contrary to the instructions provided, where the loss is unrelated to a product defect or a breach of our legal obligations. Nothing in these Terms limits liability or remedies for defective products, personal injury, express or implied warranties, or any other liability that cannot lawfully be excluded or limited.
16. Indemnity
To the extent permitted by law, you agree to reimburse EIVOGE for reasonable losses caused by your breach of Section 8 (Acceptable use) or your unlawful use of the Website. This section does not apply to ordinary use of our products and does not limit your rights as a consumer.
17. Events beyond our control
We are not responsible for delays or failures caused by events beyond our reasonable control, such as natural disasters, carrier or postal disruptions, strikes, or internet outages. If such an event affects your order, we will tell you and, where required by law or if you prefer, cancel it and refund all amounts paid. Your statutory cancellation and refund rights are not affected.
18. Severability and order of precedence
If any part of these Terms is found unenforceable, the rest remains in full effect. If these Terms conflict with a specific policy or warranty, the term more favourable to you applies.
19. Entire agreement, waiver and assignment
These Terms, together with the policies and warranty referred to in them, are the entire agreement between you and EIVOGE about the Website and your purchases from us. If we do not enforce a provision right away, we have not given up our right to enforce it later. We may transfer our rights and obligations under these Terms to a successor business, provided that this does not reduce your rights.
20. Changes to these Terms
We may update these Terms from time to time. Changes take effect when posted on this page, and the "Last updated" date will be revised. Changes will not apply to orders placed before the update.

ADDITIONAL TERMS FOR CUSTOMERS IN CANADA
C1. Orders and pricing
Orders placed on eivoge.ca are purchases from EIVOGE. Prices on eivoge.ca are shown in Canadian dollars. Applicable taxes and any charges are disclosed before you submit your order. After you submit an order, we send an electronic acknowledgement. We may reasonably decline orders affected by suspected fraud, unauthorized payment, inventory unavailability or material listing errors; if we do, we will refund any amount charged in full.
C2. Ontario internet agreement disclosures
Before you place an order, we show you the product description, the total price including taxes and shipping charges, and the estimated delivery date. After checkout, we will email you a copy of your order within 15 days. If we fail to deliver your order within 30 days of the estimated delivery date, you may cancel it at any time before delivery, and we will refund all amounts paid within 15 days of your cancellation notice.
C3. Your statutory rights
Our one-year limited warranty supplements and never replaces or restricts any mandatory warranties, legal guarantees or remedies under Canadian federal, provincial or territorial law. These rights may continue after the one-year period ends.
C4. Customers in Quebec
Quebec consumers benefit from the legal warranties under Quebec law independently of our limited warranty. Goods must be fit for their intended use and remain usable for a reasonable period in normal use, considering their price and other relevant circumstances. Our choice between repair and replacement under our limited warranty does not displace the remedies available under Quebec law. C5. Governing law
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein. If you are a consumer residing in another province or territory, you keep the protection of the mandatory laws of your province or territory and may bring proceedings there.
C6. Resolving concerns
Please contact us first so we can try to resolve any concern. Nothing in these Terms requires you to use arbitration, prevents you from going to court (including small claims court), or prevents you from participating in a class proceeding.
ADDITIONAL TERMS FOR CUSTOMERS IN THE UNITED STATES
U1. How U.S. purchases work
Products shown on eivoge.com are currently sold to U.S. customers through authorized third-party retailers. Prices on eivoge.com are for information only, and the price, payment, shipping and returns for your order are governed by the retailer where you complete your purchase. If we begin offering direct purchases on eivoge.com, the applicable U.S. purchase terms will be added to these Terms before direct checkout becomes available.
U2. Warranty rights
Our one-year limited warranty (Section 6) applies to products purchased from EIVOGE or an authorized third-party retailer. This warranty gives you specific legal rights, and you may also have other rights which vary from state to state. It is in addition to any implied warranties and other protections that cannot lawfully be excluded or limited.
U3. Governing law
These Terms are governed by the laws of the Province of Ontario, Canada, except where the mandatory consumer protection laws of your U.S. state of residence apply. Purchases made through third-party retailers are also subject to that retailer's terms.
U4. Resolving concerns
Please contact us first so we can try to resolve any concern. These Terms do not contain an arbitration agreement or a class action waiver, and you may bring a claim in any court with jurisdiction, including small claims court.
U5. State privacy rights
Residents of California and certain other states may have additional privacy rights, including the right to opt out of the sale or sharing of personal information. See our Privacy Policy and the "Do Not Sell or Share My Personal Information" link on the Website.
